On 30 April 2026, the Information Regulator published the draft Code of Conduct on the Processing of Personal Information at Gated Accesses in South Africa for public comment.

 

We understand this has prompted questions - and in some cases, real concern - around what the proposed Code may mean for estates, office parks, commercial sites, security operations and access control environments.

 

Our position is clear:

“This is a regulatory process -  not a compliance crisis.”

         The Code has not been adopted

​

         It is not yet enforceable

​

         No changes needed right now 

 

 

What is important right now is informed, practical and structured engagement with the Information Regulator before the public comment deadline on 14 May 2026.

Why ATG Digital is Taking the Lead

ATG Digital has completed a detailed operational and legal review of the draft Code together with specialist legal counsel in data protection and surveillance technology.

 

The proposed Code reflects a genuine effort to regulate access control environments under POPIA. However, there are several areas that require further clarity and practical industry input before the framework can operate effectively across real-world environments.

Because the people managing estates, business parks, logistics sites, critical infrastructure and access-controlled environments every day are best positioned to provide meaningful operational insight into how these environments actually function.

This working session is therefore designed to:
